$500 No-Frustration Guarantee

  1. Service Response Commitment. If the installed HVAC system experiences a functional breakdown within twelve (12) months of installation, the Company shall dispatch a qualified technician to the property within twenty-four (24) hours of the customer’s documented service request to diagnose the issue.
  2. Failure to Respond. If the Company fails to arrive within the stated twenty-four (24) hour period, the customer will be issued a cheque in the amount of five hundred dollars ($500.00 CAD) as liquidated damages.
  3. Exclusions and Limitations. This guarantee shall not apply where:
    1. the customer fails to provide reasonable access to the equipment or property;
    2. service is delayed due to conditions outside the Company’s control, including but not limited to severe weather events, road closures, natural disasters, strikes, or other force majeure events;
    3. the service request pertains solely to routine maintenance, filter replacement, or non-essential adjustments rather than a bona fide breakdown.
  4. Limitation of Liability. Payment of the $500.00 CAD under this guarantee constitutes the customer’s sole and exclusive remedy for failure to meet the service response commitment. No additional damages, penalties, or claims may be made against the Company under this guarantee.

General Provisions Applicable to All Guarantees

  1. Maintenance Requirement. All guarantees are contingent upon the customer performing required maintenance on the equipment in accordance with manufacturer recommendations. Failure to maintain the equipment may void coverage.
  2. Residential Installations Only. These guarantees apply exclusively to residential installations completed by the Company and are not transferable to commercial properties or subsequent homeowners unless otherwise stated in writing.
  3. Force Majeure. The Company shall not be held responsible for any delays, failures, or inability to fulfill its obligations under these guarantees arising from causes beyond its reasonable control, including acts of God, natural disasters, strikes, or governmental restrictions.
  4. Limitation of Liability. Except as expressly provided herein, the Company disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose. Under no circumstances shall the Company be liable for incidental, indirect, or consequential damages, including but not limited to lost profits, inconvenience, or property damage beyond the replacement or service remedies described herein.
